Upgrade deletes folder on web host

I don't really find it amusing that after the upgrade to 9, and posterior update of the standard infusions like News and Forum, the /forum/attachement/ folder is deleted and the /downloads/ folder as well. Only after checking things I see that the files are relocated to /infusions/forum/attachments/ and some things in the /downloads/ folders relocated to /infusions/downloads/files/, but only 1% of them.
I have about 3.8 GB in the /downloads/. They are not linked via the download system, but hot linked directly to the folder. The folder is not only gone but all links to it also broken. Of course I restore a backup, so fixed, but still, should not happen in my opinion..
